New Knoxville Man Indicted on Six Charges Following August Crash Investigation

A New Knoxville man has been indicted on six charges in Auglaize County Common Pleas Court following an alleged August traffic crash that prosecutors say left another person seriously injured.

Todd Dee Smith was indicted by an Auglaize County grand jury on two counts of aggravated vehicular assault, two counts of tampering with evidence, one count of operating a vehicle under the influence and one count of failure to stop after an accident.

According to the indictment, the alleged offenses occurred August 4 in Auglaize County.

The first aggravated vehicular assault count, a third degree felony, alleges Smith caused serious physical harm to another person while operating a motor vehicle as the result of committing an OVI offense. A second aggravated vehicular assault count, a fourth degree felony, alleges Smith recklessly caused serious physical harm while operating a vehicle.

Smith is also charged with two third degree felony counts of tampering with evidence. Prosecutors allege he altered, destroyed, concealed or removed evidence while knowing an official proceeding or investigation was underway or likely to be instituted. The indictment does not identify the specific evidence involved.

The OVI charge is a first degree misdemeanor.

Smith is also charged with failure to stop after an accident, a fifth degree felony. That count alleges Smith knew an accident or collision had occurred but failed to remain at the scene and provide the information required by law.

The indictment was filed September 3 in Auglaize County Common Pleas Court.
